Unprofessional shop and illegal practices

I place an order from the website ch.miscota.com. At this point there was no information available about the company on the website (neither in "who we are" or "contact us") and I was mislead to believe the company was based in Switzerland and the good will be shipped from Switzerland to Switzerland. When receiving the order (which was coming from The Netherlands by the way!?!?) I discovered I had to pay import fees and VAT into Switzerland then I understood I was mislead especially the order confirmation does not state the company legal adress neither! First not pleasant experience.

But that comes the tricker part here: because they decided to break my order into 3 parcels they placed 3 times the invoice for the full order into the 3 parcels. That lead the Swiss customs to invoice me 3 times the VAT and import fees as if I ordered 3 times the same articles for the entire value! In other words, they incorrectly declared the value of goods to the custom and I had to pay 3 times the Swiss VAT + custom fees at import because they mistakenly showed that each parcel has for value of goods the full value of the order while they decided to split it in 3 parcels.

After exchanging emails with their customer service and claiming the refund of extra fees/VAT paid due to their mistake, they changed suddenly the general conditions and added clause 11.9 which states that they do not have any responsibility about the custom/VAT/etc. I took screenshot of their website prior to this change. Do you believe that? How nasty is that? Now the situation is stuck as they refer to this clause and get out of any responsibility and ignore my questions.

The second part comes here: I got to know from them via our email exchanges that actually I paid the Spanish VAT on the goods for that purchase. That is an illegal and incorrect practice. As the goods are for exporting out of EU (to Switzerland) the VAT should be paid only in the country of the final destination of the goods. This is incorrect and VAT should never be paid twice. They totally ignored my additional requests to refund me the Spanish VAT as I paid Swiss one and I am not supposed to pay Spanish VAT since good left Spain.

Please run away from this company, very poor customer care, service and respect. On the light of the above, the company goes against the laws of the EU regarding the VAT - https://europa.eu/youreurope/business/taxation/vat/vat-rules-rates/index_en.htm

If you are in Switzerland as me, never order from them!
